This BLOG was established as a site to express feelings of the heart and mind surrounding the June 19, 2005 hit and run death of 15 year old Kayla Peter. The registered owner of the Lexus that killed Kayla is Susanna Goihman owner/chef of Azafran Restaurant located at 617 S. Third Street.
JUDGE JOSEPH C. BRUNO---“B” COURT, 1801 VINE STREET---9AM—--CHARGED WITH LEAVING THE SCENE OF A MOTOR VEHICLE ACCIDENT, INVOLVING THE DEATH OF 15-YEAR-OLD KAYLA PETER ON JUNE 19, 2005 ON RIDGE AVENUE NEAR SCHOOL HOUSE LANE IN EAST FALLS. ADA MARK GILSON 686-8039
Hi all...I just spoke with Mark Gilson, the Assistant District Attorney assigned to the case, who returned my call about the rescheduled case very promptly (I was quite suprised!). He said that the preliminary hearing on 9/13 has been moved to the Criminal Justice Center, Room 306 (1301 Filbert Street, main phone # 215-683-7000).
He added that this next one would be procedural, no testimony or anything, but just a status hearing. He suggested that we call him on 9/13 to see when the actual preliminary hearing would take place.
He also said that, depending on the findings of the grand jury, the case may go to the next step (I'm not sure if that's a different kind of hearing, or an actual trial?) and bypass the preliminary hearing altogether.
(During our conversation, Mr. Gilson referred to that woman as simply "Goihman"--and although he probably always refers to defendants by their last name, I couldn't help but feel a bit gratified that he didn't dignify her with "Ms.")
Thank you Gina. I wish the hearing were still scheduled for Vine Street, that way the Haallahan girls could simply walk across the alley and into the courtroom.
There is an article in today's Inquirer, Montgomery County edition, about a Chester County man who was sentenced to 4 to 8 years for hitting a woman while driving drunk. He also left the scene after the accident. He was on probation for previous DUIs. The woman lived but lost a leg. Let's pray that the grand jury will come up with the evidence needed to ensure that Goihman gets the sentence she deserves.
I am sorry to say, this seems to take years. My son Nikk Marvel was killed 11/16/04 in a hit-n-run and the woman who did it is still driving and living her life. Court dates are small milestones, but this could take 2-3 years for any real justice. Please be prepared for set backs. The law isn't black and white, and it may appear that the criminal has all the rights, but, be patient for the system to work.
Dear Nikk's Mom Thank you so much for posting. I am truly sorry for your loss. Sad to say, I believe you are right, vehicular homicide is in a realm of it's own, and that is the true injustice.
Nikk's Mom...I am so sorry for your pain. Thank you for reminding us to be steadfast and patient in our mission. And Mrs. P, thank you for reaching out to the other families who have been tragically affected by vehicular homicide and DUI. We're going to keep at this task and see it through.
Absolutely! I was just on the phone with Marie Gibbs who was at HONK FOR KAYLA for all 28 nights. Marie said there is an article in the Fallser p. 6. In that conversation I said to Marie, "Perhaps worse than waiting for justice, for the families of victims, is feeling like no one else cares. Or that people have forgotten the victim." That is not going to happen. We have to, throughout these days write editorials, post on BLOGS, talk about the victim to everyone we know: do whatever it takes to keep the name of the victim in the minds of the public. Gina thank you for all you have done, and continue to do for Kayla. Also, more of us here have to help out Dayna and Damon. Yesterday I sent a letter to the Times Herald. I hope many others do the same.
Nicole, if the hearing is at Filbert Street, that makes things a bit difficult. It would have been so much easier to simply walk across the alley to Family Court. Nonetheless I will talk with Mrs. Gallagher and ask. If Annie is not permitted to leave from Hallahan to attend, I will write a late arrival note for her. I believe many other parents might consider doing the same. As many girls as possible, from Hallahan specifically, should be there for the Judge, Susanna and "good old" Brian to see.
Here are the names from the Chester County case. Perp is Frank Oliver Lebo. Judge is Howard F. Riley Jr. Prosecutor is Deputy District Attorney Robert L. Miller.
Hi all--I received the following email today (9/7) from Mark Gilson, the Assistant District Attorney assigned to the case:
"The hearing is still scheduled for 9/13/05. However, it is a status only listing. That means that no testimony will be taken and the matter will simply be rescheduled on that date. Therefore, there is no need for anyone to come to court on that day. This was done so that we could continue the grand jury work."
Looks like I'll need to pray for patience. It's terribly frustating that this isn't moving faster, but I guess that's how the system works. I pray that the grand jury is thorough and diligent, and that when the case is finally brought against Goihman, it's rock solid.
I re-checked the Philadephia courts website, and Goihman's hearing tomorrow will be at 8:30 am (not 9:00 am) as follows:
Tuesday 9/13 8:30 am Criminal Justice Center/Room 306 (1301 Filbert Street) Case number MC 0508340011
Acoording to Mark Gilson, the Assistant District Attorney for the case, the hearing is strictly procedural and no testimony will be taken, although Goihman and her lawyer must appear.
I wish I could get the time off of work to simply be there as Goihman slithers in, but unfortunately I can't. However, I'll be there in spirit and eagerly awaiting the grand jury's findings so Goihman can face justice.

Karen are names mentioned in the article? Can you please list them. I want to look up the article. Thanks.

Mrs. P, do you know if Hallahan girls would be allowed to go to this hearing, being as it's on a school day?
